Meakong Terms & Conditions
I. Introduction
Welcome to Meakong! A mobile application that allows users to order food, grocery, and other items from local merchants and have them delivered to their doorstep. These Terms and Conditions (“Terms”) govern your use of Meakong applications and services. By using the Meakong application, you agree to be bound by these Terms.
II. Definitions
“App” or “Platform” means the Meakong mobile application and website. “User” or “Customer” means an individual who uses the App to order food, grocery, and other items.
“Merchant” or “Restaurant” means a third-party vendor who partners with Meakong to sell food, groceries, and other items through the App. “Delivery Partner” or “Rider” means an individual who delivers orders to Users on behalf of Meakong.
“Service” or “Delivery Service” means the delivery of food, grocery, and other items from Merchants to Users through the App.
“Food” or “Grocery Items” means the products offered for sale by Merchants through the App.
III. User Account and Registration
- Registration: To use the App, you must register for an account by providing your name, email address, phone number, and password. You must be at least 18 years old to register for an account.
- Account Information: You are responsible for maintaining the confidentiality and security of your account information, including your password. You agree to notify Meakong immediately of any unauthorised use of your account or any other breach of security.
- Account Verification: Meakong may verify your account information, including your email address and phone number, to ensure that you are a legitimate User.
IV. Ordering and Payment
- Ordering: You can place orders through the App by selecting the food, grocery, and other items you wish to purchase from participating Merchants.
- Order Confirmation: After you place an order, you will receive an order confirmation from Meakong. This confirmation is not a guarantee that the order has been accepted by the Merchant.
- Order Acceptance: The Merchant has the discretion to accept or reject your order. If the Merchant rejects your order, you will receive a notification from Meakong.
- Payment: You can pay for your orders through various payment methods, including debit cards, and online payment services. You are responsible for ensuring that your payment information is accurate and up-to-date.
- Payment Processing: Meakong will process your payment and transmit it to the Merchant. Meakong is not responsible for any errors or issues with payment processing.
V. Food and Grocery Items
- Food Allergens: Meakong strives to provide accurate information about food allergens, but we cannot guarantee that the information is accurate or up-to-date. If you have a food allergy, please contact the Merchant directly to confirm the ingredients used in their products.
- Food Preparation: Meakong is not responsible for the preparation or handling of food by Merchants. If you have concerns about food preparation or handling, please contact the Merchant directly.
- Product Descriptions: Meakong strives to provide accurate product descriptions, but we cannot guarantee that the descriptions are accurate or up-to-date.
VI. Delivery and Pickup
- Delivery Areas: Meakong delivers to designated areas, which may vary depending on your location.
- Delivery Times: Meakong strives to deliver orders within the estimated delivery time, but we cannot guarantee that orders will be delivered on time.
- Pickup Locations: Meakong may offer pickup locations for orders. You are responsible for picking up your order at the designated location and time.
- Delivery Partners: Meakong contracts with Delivery Partners to deliver orders to Users. Meakong is not responsible for the actions or negligence of Delivery Partners.
VII. Promotions and Discounts
- Discount Codes: Meakong may offer discount codes that can be redeemed for discounts on orders.
- Loyalty Programs: Meakong may offer loyalty programs that reward Users for repeat purchases.
VIII. Intellectual Property
- Trademarks: Meakong owns all trademarks, logos, and brand names displayed on the App.
- Copyrights: Meakong owns all copyrights in the App, including the content, design, and layout.
- Patents: Meakong owns all patents and inventions related to the App.
IX. Liability and Indemnification
- Food Quality and Safety: Meakong is not responsible for the quality and safety of food and grocery items delivered through the App.
- Delivery Issues: is not responsible for delivery issues, including delays, losses, or damages.
- User Errors: Meakong is not responsible for errors or omissions made by Users when placing orders or using the App.
- Indemnification: You agree to indemnify and hold harmless Meakong and its affiliates, officers, directors, and employees from any claims, damages, or expenses arising out of your use of the App.
X. Dispute Resolution
- Complaint Submission: If you have a complaint or issue with an order, please submit it to Meakong through the App or by email.
- Dispute Resolution Process: Meakong will review and address your complaint in accordance with our dispute resolution process.
- Governing Law and Jurisdiction: These Terms will be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising out of these Terms will be resolved through binding arbitration in accordance with the rules of the Nigerian Chamber of Commerce Arbitration.
XI. Termination and Suspension
- Termination: Meakong may terminate your account or access to the App at any time, with or without notice, for any reason.
- Suspension: Meakong may suspend your account or access to the App at any time, with or without notice, for any reason.
XII. Governing Law and Jurisdiction
- Governing Law: These Terms will be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
- Forum for Disputes: Any disputes arising out of these Terms will be resolved through binding arbitration in accordance with the rules of the Nigerian Chamber of Commerce Arbitration.
XIII. Changes to Terms and Conditions
- Notice of Changes: Meakong reserves the right to modify or update these Terms at any time, with or without notice.
- Acceptance of Changes: By continuing to use the App, you agree to be bound by any changes to these Terms.
